Devon Bank Trust Department - Putting Them Out of Business

I’ve been diligently working on letting the entire world know this bank is financially exploiting their elderly and disabled clients through guardianships. I Xeroxed their court files, wrote a 33-page report describing (in detail) financial abuse to 19 of their clients (in seven years), mailed it to every State and Federal agency I could think of, spoke to all those agencies (absolutely lovely people), Senator Kirk ordered a Federal investigation (along with everyone else in DC), I walked my adopted victims up Capitol Hill, spoke to all our legislators about the problem, sent it to the probate court judges and Chief Judge (because Devon Bank was hiding their 2011 court records from me) then I put it on Congressional record a few months ago. Devon Bank, Janna Dutton and Josh Mitzen made history. I even set up a blog on the victims’ behalf.

Last week, one of the probate court judges refused to approve Devon Bank’s fees. She said they charged way too much to manage an estate. God love that judge for looking out for the best interests of her wards.  I will publish the fees for the other banks so you can find one much more reasonably priced.  I try to court watch for all my adopted victims, make sure I know what's going on..... and now I'm adopting others while I'm on the 18th. 

I’m hoping to put that bank out of business or at least the Trust Department. I made a commitment to Rick Block (Senior VP of Trusts) and Snipped that I would do something about the fact that Snipped which just got worse. Why would Janna Dutton set up a trust account at the most expensive bank in the city if she was looking out for her clients best interests? I know, she was only looking to trap her client in guardianship to set up her retirement fund. For those of you emailing and complaining about this woman, don’t worry, I’m onto her next. Investigative Report - Guardian Abuse

This is old but reminds me of Josh Mitzen.  At the end, it shows a personal injury lawyer turned guardian.  I wonder what kind of law Josh studied?  He talks like a criminal attorney and suspects everyone of exploiting the elderly and disabled.  You see and meet people exactly like yourself.  What you suspect in others or what you're suspicious of are the same things you'd do to the elderly.  Josh had a very long list of dirty tricks.


It also says at the end that the family had to buy their loved one back.  It's so sad.

June 15th is International Elder Abuse Awareness day and I have appointments with my legislators on Capitol Hill to talk about this Devon Bank Scam, Janna Dutton and her churning buddy, Josh Mitzen.

Janna Dutton - Is She Crooked?

A lot of you are telling me that you wouldn’t even consider hiring her firm because you’re afraid that she’s going to introduce Josh Mitzen (private paid guardian at $100 an hour for his professional services) into your life then you’d lose custody of your loved one. Because of these comments, I want to clear this up in regard to what happened to me.

First of all, when Ludwig hired Janna, she was a good advocate for him. I didn’t know this at the time (because I was only doing what Ludwig asked) but she was a good advocate for me as well since I was his Power of Attorney over healthcare. I never thought of her as supportive to me but in retrospect, she was.

"Snipped" (September 2008), she became a very poor advocate for her client because Josh is self-serving and wasn’t concerned about Ludwig at all. But she became a good advocate for Josh who neglected Ludwig.

My problem with Janna is that she set Ludwig up with a Living Trust which is another word for “Predatory Trust.” Snipped and the day after Ludwig transferred his money to Devon Bank, Sally Griffin (bank trustee) told me she can’t figure out whether or not she wants to keep me on since she hired Josh for my position (and I didn't know she meant as his Power of Attorney over healthcare at the time). She also couldn't figure out how to give Ludwig his own money.

I wrote Janna exactly that. (I have the letter. I also know she read it because Sally mentioned it when she told us that Devon Bank has ATM cards and she’s giving Ludwig one. Believe me, Janna had something to do with her little epiphany.) So,Snipped BUT she told them to knock it off.

Why didn’t she help them steal Ludwig’s estate from the get go if she’s so crooked? Was it too soon? Would it look like funny business was going on if she assigned her friends too quickly?

Do you want to know what I think Janna's problem is? She can’t remember her clients. If she’s not crooked, then she has a very poor memory so they (trustees at Devon Bank) laid low for a few months, thought up a lie to tell her (in order to get Josh assigned) and Janna fell for it hook, line and sinker. Ludwig’s entire estate and life went to hell in a hand basket overnight.  (I found out this is common practice at Devon Bank.  They have a three month thing with their clients, probably write it on their calendars.  Ludwig opened his trust in June, three months later, they assigned Josh Mitzen.  Same thing after they threw me out.  Three months later, Snipped.  I've also noticed this in some of their other clients.  After setting up a trust account, snipped).

Which is my second problem with Janna. She doesn’t investigate anything on her own. She doesn’t check facts or rely on her own common sense. I also told her (before I moved) that Devon Bank would throw out Ludwig’s entire estate and the extraordinary measures I took to help her keep track of it. (Lucky for her, she has me to inventory it.) But I’m telling her (the entire time) that she’s surrounding Ludwig with professional gold diggers and yet she did nothing about it other than make sure he was he was really secure in their clutches.  She was NOT his advocate.  Far from it.

In other words, the will Ludwig wrote means that he bequeathed his entire life savings and all his personal possessions to the two trustees at Devon Bank.  Janna Dutton set it up for him that way and did nothing to protect her client.  She made her friends wealthy.

That said, if you hired Janna to set up a power of attorney (or guardian), she’s not going to invite Josh Mitzen into your life. Why would she? He’s an attorney that took the public guardian quiz. That’s how he makes a living and inviting him into your life would be a conflict of interests. He's an interloper.  In my opinion, he can't establish his own loving relationships so he steals yours. 

But this is what has me so confused about Janna Dutton’s credibility. She set up a Predatory Trust (January 2008), she knew the vultures were circling (June of 2008), forced Ludwig into public guardianship (September 2008), knew they were squandering his estate (and I can't tell you how many times I mentioned this to her but it was constant) THEN in February 2009, she looked me dead in the eye and told me that she doesn't know what's going on.  She only knows what Sally Griffin and Josh Mitzen tell  her (and basically tells me that she does as she's told).  But this is not true because I told her myself (I can prove it).  Does she have a poor memory or is she also self-serving? My conclusion? Does it make a difference? Just ask yourself if you want her to set up your future and have her looking after you.  THAT is what you should concern yourself with in regard to hiring this attorney, not whether or not she's going to introduce Josh Mitzen.  (This is what I thought several months ago when I wrote it.  Janna DOES invite Josh into the lives of her clients when she knows it's a conflict of interests because he makes her money.  She can churn the bill because he causes chaos and animosity among family members and everyone else.  So, if you hire this law firm, put several zeroes behind the amount she quotes you.)

Make sure that NO ATTORNEY sets you up with a living (or predatory) trust. That’s Rick Block’s dream come true and I’m sure he’s not the only trustee that gets off on one.

Marked for Destruction

There's a link to her site at the bottom of the page.  They put Adele Fraulen's "true story" in a Boston Legal episode and I watched it last night. 

This is how Alan Shore (James Spader) describes guardians/conservators on the show:

“Many conservators are perfectly qualified, but the lesser ones are akin to the jackal. They sniff around hospital corridors hunting for senior citizens with no family ties. When they corner one the conservator goes before a judge with an emergency motion, the judge, overburdened with caseloads quickly grants them a Power of Attorney, and suddenly they sink their teeth into that senior’s life. They seize their assets; strip away all their decision making powers, then run up charges feeding off the estates until the bones have been picked clean.”

OMG!  Very sad but very true!  Then later, after the court orders a psychiatrist to examine Adele, they meet outside the courtroom and Alan says to the guardian:

"Mr Wharton, unfortunately what may seem like a small victory is really just postponing the inevitable. We will prevail and since I know you’re anxious to get home and rake your shag carpet, why don’t you just let this one go?"

The guardian replies “Well, mostly because I’m mad. And for Adele’s sake I’m willing to stay in this for the long haul. I’ll hire my own high-price attorney’s at five hundred dollars an hour. And you know where that money comes from don’t you? Adele’s bank account. That’s what it’s there for. To insure the well-being of my client. But don’t worry, I’ll eventually stop battling you. Once all the money’s run out.”

Brought back memories of Josh Mitzen screaming in my ear, saying that I could fight him in court for Ludwig.  He insinuated that he wouldn't spare a dime of Ludwig's money to force himself on a man that never wanted him in his life in the first place.

Then on the show they talk about how they're selling Adele's home in order to pay the public guardian fees, etc., etc.  James Spader ends up hog tying the guardian and making him feel exactly how their wards feel.  Needless to say, it was a very happy ending.  Adele got free of the guardian just like in John Caravella's story.  You should read his book.  It's EXCELLENT!

Common Practice, it seems......

These are excerpts taken from the GAO report:

"Also, the guardian neglected to collect $39,000 of rental income for over four years on behalf of one victim."

Ludwig and I couldn't find his rental income either.  I know Root Realty did their job in collecting the money, it just never made it into Ludwig's trust account.  Your guess is as good as mine as to where that money went (and that realty company was paid $250 a month to manage two empty apartments, then just one apartment for a while).  Devon Bank was EXCELLENT when it came to passing out Ludwig's money, collecting it or making him any was another story.  (You also can't check on the banks accuracy since Rick Block has "free reign over the old man's half a million dollars!  No courts to go through!"  That's what he was bragging about when Ludwig opened his trust account at Devon Bank and no trustee is going to get that excited unless they have something to gain by it "in my opinion.") 

"The guardian hid the man's will from the court and family members..."

Another common practice at Devon Bank. I'll tell you after Ludwig passes away why they wouldn't cough this thing up aside from Mr. Block's "free reign" and the fact that not only aren't the courts watching them but obviously no one at the bank is watching those two trustees either.  I'll let you know if Ludwig's family inherits anything.

"For example, she noted that the company had purchased mental health support services for the veteran at a rate that was 1500 percent higher than necessary."

Devon Bank does the exact same thing when hiring Home Instead Caregiving Agency.  Their clients pay an OBSCENE amount of money for caregivers even if they don't want them or need them, they're forced.  When a Senior Citizen requires 24 hour care, it's more economical for them to go straight into daily rates instead of hourly.  The trustees at Devon Bank don't do this, they force their clients to continue at the hourly rate which is more than double.  When Ludwig complained about all the caregivers coming, the trustees just set him up with more and billed him more money (then, Home Instead had all kinds of things going on at Ludwig's house while he wasn't even home, just to get paid.  They made excuses to bill him but what do you expect when no one is minding the till and the bank has free reign?).  Not to mention, you have a private paid guardian who is pushing lift chairs and wheelchairs on his clients.  It's obvious they want their clients to physically deteriorate in order to move Home Instead in then bill them an outrageous fee for their "professional care."  Caregivers wouldn't even be hired if they let their clients exercise, get up or walk on their own but they don't.  Trust me, there's no $$$$ in it.

I bet Rick Block is a coin collector.  (To all my anonymous posters, you don't need to tell me whether or not this is true, my intuition tells me all I need to know.  I saw the way he was looking at Ludwig's coin collection, the man was a goner.)   But I think all their homes should be looked at by the families (who had trust accounts at Devon Bank) to check to see if anything looks familiar.

"When her clients moved into a nursing facility, the permanent guardian would throw away everything in their houses......."

Another common practice at Devon Bank and Ludwig wasn't even moved to a nursing home before the trustees threw out his personal property.  They just tossed his possessions out right in front of Ludwig and the entire world.  Called the junkman.  Can you imagine? 

"The court recommended that it could either appoint the attorney to serve as the victim’s guardian, or allow the attorney to continue to serve as the victim’s trustee instead. However, in the end, it allowed both to occur...."

I don't know what difference this makes?  This is "my opinion" of the trust department at Devon Bank.  I watched Sally Griffin order Rick Block around.  She did all the talking and when we were emptying Ludwig's lockbox, she told Rick what to do and he did it.  (The reason I paid so much attention to this was because she was so disrespectful to Ludwig.  If she had any respect for her boss or employer she wouldn't disrespect her client but he didn't command any.)  Then I watched Josh Mitzen (hired by Devon Bank to be the guardian in order to steal estates out from underneath the heirs who inherit) order Sally around.  So, "in my opinion" Josh Mitzen is Senior Vice President of the Trust Department down at Devon Bank.  He definitely runs the show.... kind of like a pecking order.  Josh is over Sally, she's over Rick.  So, what difference does it make about guardian of the estate and guardian of the person?

After looking at Ludwig's trust account, watching the theives they hired come through his front door, the way the two trustees squander his money and his estate, I've come to the realization that they're (two trustees) are not out to make their employer money.  BUT that's only what I can see (by looking at their expenses), they may very well be making their employer all kinds of money "on the side."  I don't know? 

I remember several months ago, a woman left 7 million to a college.  The woman lived just like Ludwig, very simply, in a small home.  My first thought?  She didn't open a trust account at Devon Bank because they would have appointed a "care manager" then deemed her incompetent, sold her property and spent her 7 million before she died so no one inherited.  Most of it probably going to the guardian, their attorney and caregivers.  This woman got lucky.  She had a reputable attorney.  (Marlatt, I'll never forget his name.)

The good thing about this GAO report is the fact that these guardians/conservators are getting fined and imprisoned.  There is justice in the world.
